Bierstube owner to pay fine

The prosecutor of Nizhniy Tagil Leninskiy district insisted that the owner of Bierstube beer restaurant face administrative liability for reproducing musical pieces without the consent of the copyright holders, the spokesperson for Sverdlovsk Region public prosecution authorities reports.

‘The inspection carried out by the prosecution officers and the forces of Nizhniy Tagil Internal Affairs Department helped us detect that a DVD player was used on the premises of Bierstube Restaurant at Parkhomenko St. in Nizhniy Tagil to play Doo Uap, Doo Uap, Doo Uap (performed by Gabin, composed by Edward Kennedy ‘Duke’ Ellington). However, the restaurant owners did not sign the agreement necessary to use the authors’ intellectual property either with the authors or with the Russian Authors Society,’ the spokesperson explains.

As a result, the restaurant director got involved in an administrative lawsuit, with charges based on Article 7.12 (part 1) of the Russian Federation Administrative Offense Code (copyright infringement for profit-making purposes). Having considered the case, justice of the peace imposed a 10,000-ruble fine on the offender and required that the DVD player be confiscated.
