Yekaterinburg: Customer Sues Svyaznoy For Defective iPhone

UrBC, Yekaterinburg, February 22, 2018. Verkh-Isetsky Court of Yekaterinburg ruled that Svyaznoy Logistika must pay their customer RUR 144,000 for a bloated iPhone, Sverdlovsk Oblast Court’s press service reports.
‘A Yekaterinburg-based customer bought his Apple iPhone 7 128 Gb for RUR 55,490 at one of Svyaznoy Logistika outlets last June. In August, the smartphone got inflated and stopped charging when connected to a charger. As it was no longer fit to use, the customer took the phone back to the store to have it replaced or get a refund,’ the press service says.
The store only agreed to have the smartphone warranty-repaired. An expert examination proved that the phone battery got inflated due to an internal fault, which falls into the category of production defects.
The customer took the case to Verkh-Isetsky Court of Yekaterinburg. The court looked into the files and ruled the plaintiff’s demand to have their purchase and sale agreement declared void and to get the money paid for this Apple iPhone 7 (RUR 55,490) back was legally grounded. Svyaznoy Logistika would also have to pay RUR 25,000 in forfeit penalties, RUR 2,000 in damages, RUR 41,245 in fines, RUR 6,000 in experts’ fees, and RUR 15,000 in legal fees.
