ComsoMall Management Company to Join ComsoMall Shopping Center’s Lawsuit

OOO ComsoMall Management Company is now involved in the case Megalomania Advertising Agency vs. Sverdlovsk Region division of Russia’s Federal Antimonopoly Service on a third party basis. Sverdlovsk Region Arbitration Court’s preliminary hearing has been set for July 17, 2012.
The FAS’s Sverdlovsk Region division found Megalomania guilty of an administrative offense. On March 11, 2012, the division declared that ComsoMall Shopping Center’s ad that read, ‘Siniye Kamni has people living there, too’ and ‘ZhBI is no ghetto’ was improper. The ad was distributed by Megalomania via billboards around Yekaterinburg in May-July 2011. The FAS stated the ad violated Article 5 (Part 6) of the Advertising Act, as the slogans used some offensive comparisons and expressions.
Now under Article 5 (part 6) of the Advertising Act, an advertisement cannot contain any slurs or indecent or offensive images, comparisons, or expressions.
Under Article 38 (part 6) of the Advertising Act, it is the account who is responsible for any violation of the requirements set forth in Article 5 of the Advertising Act.
The co-accounts for ComsoMall Shopping Center ad are OOO Megalomania Advertising Agency and OOO ComsoMall Management Company. Megalomania is also the agency that produced the advertisement for ComsoMall Shopping Center.
The FAS’s Sverdlovsk Region division imposed a 150,000-ruble fine on OOO Megalomania Advertising Agency.
