Court Dismisses Church’s Complaint on College Buildings in Yekaterinburg

UrBC, Yekaterinburg, October 10, 2018. The 17th Appeals & Arbitrations Court dismissed the complaint placed by Russian Orthodox Church’s Yekaterinburg Diocese regarding Sverdlovsk Region Arbitration Court’s earlier ruling on a set of college buildings in Yekaterinburg.

The case was first heard in Sverdlovsk Region Arbitration Court in June 2018; the Diocese asked for the three buildings to be handed over to the church. The court dismissed the Russian Orthodox Church’s claim, so the plaintiff took the case further to the 17th Appeals & Arbitrations Court.

Now Russian Orthodox Church’s Yekaterinburg Diocese demands that Sverdlovsk Region’s Ministry for Public Property Management convey the buildings of Yekaterinburg Economics & Tech School, Sverdlovsk Boys’ Choir School, and Yekaterinburg Assemblage School to them. According to the plaintiff, the three buildings in question used to belong to the church prior to the October Revolution of 1917.

Once the ministry had refused to comply, the diocese went to Sverdlovsk Region Arbitration Court; the court, however, dismissed the church’s claim. The 17th Appeals & Arbitrations Court supported the original court’s ruling.

Ural Federal District’s Arbitration Court sustained the church’s claim in March 2018, however: this time, both the original ruling and the court of appeal’s ruling got dismissed and the case was scheduled for yet another hearing.
