FAS Finds Out Russian Railways, RoszheldorProject Violate Antimonopoly Law

On September17, 2012, Sverdlovsk Region division of Russia’s Federal Antimonopoly Service declared Russian Railways and RoszheldorProject guilty of violating Article 10 (part 1) of the Competition Protection Act, the agency’s press service reports.

Legal action was taken on November 24, 2011 following an appeal by SNT Parus regarding Russian Railways and RoszheldorProject violating the Competition Protection Act.

Sverdlovsk Region division of Russia’s Federal Antimonopoly Service detected that on November 10, 2011 RoszheldorProject, acting on behalf of Russian Railways, and SNT Parus signed an agreement for the technological hookup to the electrical network of Russian Railways; the contractual obligations were to be met by May 10, 2012.

Yet Russian Railways did not take any action to actually connect SNT Parus’s facilities to its network within the set deadline; nor did it provide any explanation as to why nothing had been done.

Violation of Article 10 (part 1) of the Competition Protection Act consisted in Russian Railways and RoszheldorProject’s economically and technologically ungrounded refusal to meet the contractual obligations stemming from their technological hookup agreement with SNT Parus, which infringed upon the latter’s interests.
