Court to hear STK vs. Enel OGK-5 on April 13

The claim laid by Sverdlovsk Heat Supply Company (STK) against Enel OGK-5 will be heard in Sverdlovsk Region Arbitration Court on April 13, 2012. The claim is related to forcing the defendant to sign a heat energy supply agreement.

The hearing of the claim began in December 2011 when STK went to court with a claim on forcing the defendant to sign a heat energy supply agreement with them on the plaintiff’s terms. The defendant provided a written renouncement of the claim, referring to the fact that the draft agreement on the energy and feed water supply No. 3215 they had received had actually been considered by the company. As the said draft agreement did not include some important terms, it could not be treated as an offer under the terms of Article 435 of Russia’s Civil Code. This is why Enel OGK-5 issued a new offer, that is, a draft agreement containing all the provisos prescribed by the current legislation.

Enel OGK-5 feels that the proposals in the defendant’s draft agreement offer nondiscriminatory terms to all the users buying heating energy from the defendant.
